PROFILE

Anirudh Gotety practices Indian civil and commercial litigation, international arbitration, and commercial and regulatory advisory. With extensive experience in India, he has also worked with leading arbitration practices in the United States and Singapore in complex cross-border arbitrations. He brings to his disputes practice the perspective of a former M&A and Private Equity lawyer, allowing him to approach commercial disputes with transactional insight.

At Three Crowns and Hughes Hubbard & Reed in Singapore and Washington DC, Anirudh worked on arbitrations under SIAC, HKIAC, and LCIA rules, including on matters involving the infrastructure, energy, and aerospace industries.

In India, Anirudh has appeared before the Supreme Court, Delhi High Court, district courts, and tribunals such as the NCLT, NCLAT, APTEL, and NCDRC, and has acted in ad-hoc and international institutional arbitrations with Keystone Partners on complex multi-million dollar disputes. He has also been credited by the Supreme Court of India for arguments in reported judgments. He started his career at Luthra and Luthra Law Offices where he advised on large M&A transactions, including ArcelorMittal-Nippon Steel’s US$5.8 billion acquisition of Essar Steel.

REPRESENTATIVE CASES AND DEALS

Arbitration

$50mn LCIA arbitration: represented one of India’s largest e-commerce companies against the seller of a recently acquired company for breach of representations under a share purchase agreement.

US$5 billion SIAC arbitration: assisted in the representation of a consortium member in a payment and extension-of-time dispute arising from a mega infrastructure project in Southeast Asia.

$150mn HKIAC arbitration: assisted in the representation of an aerospace equipment supplier in a wrongful termination dispute.

LCIA proceedings: advised a contractor on payment and performance claims arising from a power plant construction dispute.

$100mn HKIAC emergency arbitration: assisted in the representation of a Cayman Islands company in relation to breaches of a shareholders’ agreement.

$100mn UNCITRAL investment arbitration: assisted in the representation of a French national against the Dominican Republic.

Assisted in the representation of the Singapore Stock Exchange against India’s National Stock Exchange on a NIFTY derivatives trading dispute.

Litigation

Represented a shareholder group in a $75mn dispute of title to company shares before the Supreme Court of India.

Represented Snapdeal in award set-aside proceedings before the Delhi High Court against one of its sellers.

Represented the All India Gaming Federation before the Supreme Court of India on the legality of fantasy sports and gaming apps.

Represented multiple creditors before the National Company Law Tribunal in insolvency proceedings.

Represented a contractor in arbitration-related proceedings before the Delhi High Court.

Credited by the Supreme Court for arguments in K. Srinivasappa v. M. Mallamma, (2022) 17 SCC 460, concerning enforcement of compromise decrees.

Handled multiple succession disputes representing opposing family groups before the Delhi High Court and District Courts.

Appeared in major constitutional and governance matters, including challenges to the GNCTD (Amendment) Act 2021, PIL on illegal felling of heritage trees for Bengaluru Metro, and defence of the Indian Council for Child Welfare funding policy.

Filing and arguing related partition suits and appeals before the Delhi High Court and Tis Hazari District Courts over valuable property located in Delhi.

On retainer with one of India’s most valuable cosmetics companies for commercial advisory.

Represented a politician before the MP High Court, Jabalpur Bench in defamation and quashing proceedings.

Representing a group of landowners before the Supreme Court in an SLP over disputed property acquired in a public auction.

Represented a cooperative bank before the Supreme Court in an SLP over a pension liability and service law dispute.

Appeared and represented clients in PMLA matters before the PMLA Appellate Tribunal and Delhi High Court.

Represented and secured discharge of a power of attorney holder before the Supreme Court in an SLP over alleged fraudulent transfer of property.

On retainer with a market-leading Indian cosmetics company for ongoing corporate and contentious advisory.

Advised the Carlyle Group on its $200mn acquisition of an Indian pharmaceutical manufacturer.

Advised ArcelorMittal–Nippon Steel on the $5.8bn acquisition of Essar Steel under the IBC.

Advised ArcelorMittal India on post-acquisition transition, vendor contracts, and regulatory engagements.

Advised a major Delhi-NCR real estate group on land purchases and development agreements.
